FARGO, N.D. (AP) — A man convicted of murder in Fargo more than two decades ago will not get the new trial he sought.

East Central District Judge Frank Racek has ruled that Reginald Tweed failed to show that his attorney in the case did a poor job. Tweed tells KVLY-TV that he will appeal.

Tweed is serving a life sentence for killing 32-year-old Terry Dorff by hitting him five times in the head with a 17-pound rock, after Dorff allegedly make sexual advances while they were drinking in Dorff's apartment in 1991.

A second man also was charged with murder in the case. David Sumner was acquitted after Tweed refused to testify against him.
