A North Dakota legislator who voted against expanding gay rights have come out as gay, and admitted he sent a graphic picture of his genital are to another man..

The Fargo Forum reports State Rep. Randy Boehning (R-Fargo) claims the disclosure of the photo is "payback" for his opposition to Senate Bill 2279, who would have expanded the rights of gays and lesbians in North Dakota.

The disclosure came when Dustin Smith, a 21 year-old from from Bismarck contacted the Forum saying he recognized Boehning from a gay dating smartphone app called Grindr.

Boehning admitted to contacting Smith and sending him the graphic picture.

"That's what gay guys do on gay sites, don't they?" he said.
