Have you ever wondered if you legally have to roll down the window when a police officer pulls you over?

I was driving down Memorial Highway yesterday, and I saw an officer buzz past me and pull over another car. It got me thinking: what do you LEGALLY have to do in those situations?

What To Do

Getting pulled over can make you a nervous wreck. Here are a few tips to help shepherd you through the stressful experience.

  • First, pull over (Obviously). I've seen people stop their cars in the middle of the lane and not even pull off to the side. I can only assume they were frozen in fear, and thinking about how that may block traffic and be dangerous escaped them in that moment of panic. Anywho..
  • Second, keep your hands visible. Keeping your hands on the steering wheel is always a good idea.
  • DON'T get out of the vehicle unless instructed to do so.
  • Grab your license, insurance, and registration cards when instructed to do so by the officer.
  • If it is dark, you can turn on the interior lights so you are visible to the officer.
  • Answer questions, but DON'T argue with the officer. Save that for court if you choose to contest the ticket.

Rolling Down The Window

To answer the question, "Do you legally have to roll down your window?" I'd say yes.

The North Dakota Century Code 39-10-02 states, "No person may willfully refuse to comply with any lawful order or direction of any police officer or firefighter invested by law with authority to direct, control, or regulate traffic."
