An "independent" candidate who came in third in the 2012 gubernatorial election wants the results thrown out.

Paul Sorum is asking for the retroactive removal of the Democrat and Republican candidates from the ballot -  and a recertification that would make him the winning candidate.

Sorum told the Fargo Forum the rule he's invoking is the same one cited by Attorney General Wayne Stenehjem when removing Libertarian Party candidate Roland Riemers from the ballot.

A hearing is set for Monday morning at the Morton County Courthouse in Mandan.
